Terms of Service

Rules for using the site and the community features.

Welcome to cogole.to. These Terms of Service govern your use of the site and the interactive features (postcards, reviews, polls, scavenger hunt). Browsing the site implies acceptance; creating an account implies acceptance of the privacy policy, the community guidelines, and the cookie policy as well.

1. Who we are

cogole.to is an independent tourist guide for the village of Cogoleto (Liguria, Italy), run privately and not for profit. It does not represent the Municipality of Cogoleto, the official Tourist Office, or any public body. For official information, see the contact page.

2. What we offer

A free tourist information site about Cogoleto, complemented by user-generated content (photo postcards, reviews, polls, scavenger hunt). Interactions require an account; browsing is free and anonymous.

The essential features of the service (art. 67 et seq. of the Italian Consumer Code) are: free access to the tourist information and, upon registration, to the interactive features listed above. The service is free, entails no payment obligation and no subscription.

3. Account and registration

To take part in interactions you can create an account via:

  • Google, Facebook, Instagram, Apple (OAuth)
  • Email magic-link (a secure one-time link sent to your inbox)

To register you must:

  • be at least 14 years old (digital-consent threshold under Italian Privacy Code art. 2-quinquies);
  • provide truthful information (at minimum email and display name);
  • safeguard your account and means of access (OAuth provider or mailbox).

We may refuse or terminate an account that violates these Terms, the community guidelines, or the law.

4. User-generated content

4.1 What you post

When you upload a postcard, write a review, vote on a poll or register a check-in:

  • you confirm you are the original author or have the right to publish it;
  • you confirm the content does not infringe third-party rights (copyright, likeness, trademark, confidentiality);
  • you accept that the content is subject to prior moderation and may be rejected or removed at our discretion, reasoned against the guidelines.

4.2 Licence you grant us

You retain ownership of your content. By publishing on cogole.to you grant us a:

  • non-exclusive (you may publish it elsewhere);
  • royalty-free;
  • worldwide;
  • purpose-limited licence for display on cogole.to, backups, and inclusion in editorial collections of the site (e.g. "postcards of the week", newsletter, social).

The licence terminates automatically when the content is deleted by you or us. Copies already published elsewhere (e.g. third-party screenshots, web archives) are outside our control.

4.3 What you may NOT post

See the community guidelines for the full list. In short: no illegal, offensive, discriminatory, sexually explicit, unauthorised commercial content; no other people's personal data; no stolen photos; no shots of someone else's licence plate or doorbell.

4.4 Reporting procedure

If you believe content violates your rights (e.g. your photo published without permission, a defamatory review) or applicable law:

  • email [email protected] stating: URL of the content, identification of the reporter (including representation if applicable), nature of the violation, evidence of the right infringed where applicable;
  • we review within 5 business days;
  • if the report is well-founded we remove the content and notify the author.

For copyright takedown notices under Directive (EU) 2019/790 (DSM), attach documentation equivalent to a DMCA notice: identification of the protected work, statement of good faith, complete contact information.

5. What you can expect from us

We work to provide a reliable service, but the site is provided "as is" without express warranties. In particular:

  • Availability: we do not guarantee 24/7 uptime. The site may be offline for maintenance, errors, or force-majeure events.
  • Content accuracy: we do our best (opening hours, prices, events, ARPAL classification) but reality changes quickly. Always verify critical information with official sources (Tourist Office, Municipality, restaurants).
  • Reviews and postcards: are opinions of individual users, not site positions.
  • Third-party services (Google Analytics, Google Maps, OAuth providers): are governed by their own terms and policies. We are not responsible for their operation.

6. Liability

cogole.to's liability is governed by Italian law (the Civil Code and, for consumer users, the Consumer Code). As this is a free service offered on a personal, non-professional basis, we do not guarantee uninterrupted service or freedom from errors (see §5): always verify critical information (opening hours, prices, events, bathing-water status) with official sources.

User-posted content (postcards, reviews, votes) reflects the opinions of its authors: the owner acts as a hosting provider and acts promptly on reports (see the guidelines and legal notice). Third-party services (OAuth providers, Google Analytics and reCAPTCHA, maps) follow their own terms.

In all cases, non-waivable consumer rights and liability for wilful misconduct or gross negligence are unaffected and cannot be excluded or limited.

7. Suspension and termination

We may suspend or terminate an account that:

  • violates these Terms or the guidelines;
  • engages in illegal, fraudulent, or harmful activities;
  • circumvents technical systems (rate limits, anti-abuse, scavenger-hunt anti-cheat).

You can close your account at any time from the profile page — see the privacy policy §5.

8. Intellectual property of the site

The design, original text, source code, cogole.to logos, and the site's editorial content are protected by copyright. They are re-usable with explicit attribution (CC BY-SA 4.0 for the text, unless otherwise stated).

Photographs belong to their respective authors — see the footer or below each image for credits.

9. Changes

We may update these Terms. Material changes are notified by banner on your next visit. Continued use of the site after notification is acceptance.

10. Governing law and jurisdiction

These Terms are governed by Italian law. If you are a consumer, any dispute falls under the exclusive jurisdiction of the court of your place of residence or domicile (art. 66-bis Italian Consumer Code); otherwise the court of Genoa has jurisdiction.
